StayAlive Terms of Service

StayAlive is an application developed and operated by Collabwire P.S.A.
located at ul. Długa 29, 00-238 Warsaw, Poland
(KRS: 0000988718, NIP: PL 525-292-09-49).
1. Acceptance of Terms
By using the StayAlive application, you accept these Terms of Service.
If you do not agree with any provision, do not use the application.
2. Definitions
"StayAlive" or "Application" – mobile application and related services enabling daily safety check-ins.
"User" – any natural person using the Application, including:
- Primary User (e.g., family member),
- Protected User (e.g., senior performing check-ins).
"Check-in" – voluntary confirmation by a Protected User that they are feeling well, performed through the Application.
"Subscription" – paid service providing access to premium features of the Application.
"Alert" – notification sent to Users according to the Application's configuration, particularly in case of a missed check-in.
3. What StayAlive Is
StayAlive is an informational and communication tool enabling families to monitor the regularity of daily check-ins of their loved ones.
StayAlive:
- is not a medical service,
- does not provide healthcare,
- does not replace personal care, medical visits, or emergency numbers.
The Application serves solely to transmit information and notifications.
4. Scope of Responsibility
Users acknowledge that:
- check-ins are voluntary and dependent on the action of the Protected User,
- lack of check-in does not automatically mean a threat to life or health,
- decisions made based on alerts remain with the Users.
StayAlive does not guarantee that:
- a check-in will be performed,
- an alert will be received or read on time,
- a notification will prevent harm or a random event.
5. No Emergency Services
StayAlive does not monitor health status in real time
and does not automatically contact emergency services.
In emergency situations, you should always use local emergency numbers
(e.g., 112).
6. Automation and Configuration
The Application may use:
- automatic reminders,
- alerts after a specified time without check-in,
- notifications to multiple Users.
Users are responsible for:
- proper configuration of the Application,
- keeping contact data up to date,
- conscious use of automatic features.
7. Payments and Subscriptions
7.1 StayAlive Subscriptions
- Subscriptions provide access to premium features (e.g., unlimited family members, advanced alerts).
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the billing period.
- The User has the right to withdraw from the contract within 14 days of activation, in accordance with applicable consumer protection regulations.
- Payments are processed by authorized payment service providers in accordance with PSD3 and strong customer authentication (SCA) requirements.

8. Suspension or Termination of Account
StayAlive may suspend, limit, or terminate access to the Application in case of:
- violation of these Terms,
- abuse or actions inconsistent with the Application's purpose,
- legal requirements or system security.
Where possible, the User will be informed of the reason.
9. Limitation of Liability
To the maximum extent permitted by law:
- StayAlive is not liable for indirect, incidental, or consequential damages,
- StayAlive's total liability will not exceed fees paid by the User in the last 12 months.
These limitations do not apply to damages resulting from intentional action or gross negligence.
10. Intellectual Property
The entirety of the Application, including in particular:
- source code,
- user interface,
- graphics,
- algorithms
is the property of Collabwire P.S.A. or its licensors.
Users retain rights to their personal data in accordance with the Privacy Policy.
11. Privacy
The rules for processing personal data are described in the StayAlive Privacy Policy, available in the Application and on the website.
12. Changes to Terms
Terms may be updated at any time.
Users will be notified of significant changes at least 14 days before they take effect.
Continued use of the Application after that date constitutes acceptance of the changes.
13. Governing Law and Jurisdiction
These Terms are governed by the law of Poland and the European Union.
All disputes are resolved by courts competent for Warsaw,
with respect for absolutely binding consumer rights.
